  • Pricing & Guests: Base price covers up to 6 guests and includes fuel. Extra guests beyond 6 incur a per-person charge.
  • Activities & Time: Not all activities fit in short charters (e.g., fishing and snorkeling in 2–3 hrs).
  • Cancellations (Guest): 48h+ full refund; 24–47h 50% refund; <24h or no-show: no refund.
  • Cancellations (Operator): Unsafe weather/mechanical: reschedule or full refund (excludes third-party costs).
  • Weather & Safety: Captain may adjust routes/activities. Guests must follow crew instructions.
  • Liability: Water activities carry inherent risks; you accept these when booking. We’re not liable except for proven negligence under applicable law.
  • Law: Governed by the laws of the Turks & Caicos Islands.

  • Payment Information: Processed securely by our payment providers; we do not store full card numbers.
  • Communications: Messages you send us (email, forms, SMS/WhatsApp), reviews, service feedback.
  • Technical Data: IP address, device/browser info, pages viewed, and cookies for analytics and site performance.
  • Media (optional): Photos/videos captured during experiences if you consent to marketing use.

2) How We Use Your Information

6) Payments

Payments are processed by third-party providers using encryption and industry-standard security. We receive confirmation of your payment status, not your full card data.

7) Data Retention

We keep your information only as long as needed to provide services, meet legal obligations, resolve disputes, and improve operations. When no longer needed, we delete or anonymize it.

8) Your Choices & Rights

  • Access & correction: Ask for a copy of your data or to update it.
  • Deletion: Request deletion when we no longer need your data.
  • Marketing: Opt out at any time via the email footer or by contacting us.
  • Cookies: Manage cookie preferences in your browser.

Terms & Conditions

1) Booking & Confirmation

  • Reservations are confirmed upon successful payment; a confirmation email will be sent.
  • Please verify charter date, time, number of guests, and inclusions upon receipt.

2) Cancellation & Weather Policy

  • 24+ hours before departure: Full refund.
  • Within 24 hours / No-shows / Late arrivals: Non-refundable.
  • Unsafe weather or mechanical issues: Captain/company may cancel or reschedule; you may choose a full refund or a new date/time.
  • Tours begin and end on schedule; late arrivals do not extend charter time.

3) Payments, Chargebacks & Fraud Protection

  • Payments are processed by PCI-compliant providers. We do not store full credit card numbers.
  • Chargebacks: Filing a chargeback without contacting us first may be disputed with evidence (signed waivers, receipts, vessel GPS logs, time-stamped photos, crew statements).
  • Fraud Prevention: We utilize anti-fraud tools and reserve the right to cancel any booking suspected of unauthorized card use or fraudulent activity.
  • Chargeback Protection: By booking, you acknowledge these Terms and authorize the transaction. Service delivery is evidenced by boarding records and captain logs.

4) Liability, Safety & Conduct

  • All water-based activities involve inherent risks. Participation is voluntary and at your own risk.
  • Guests must follow captain/crew instructions at all times. Failure to comply may result in activity or charter termination without refund.
  • Life jackets are mandatory for children and available for all guests.
  • Alcohol/Drugs: Responsible drinking is permitted. Excessive intoxication, illegal substances, or unsafe behavior may result in refusal of service or early termination of the trip with no refund.
  • Watersports: Activities such as tubing, sea scooters, wakeboarding, Subwing, snorkeling, cliff jumping, jet ski/jetcar, and fishing are conditions-dependent and may be canceled or modified for safety.
  • You are responsible for personal belongings; the company is not liable for loss or damage to personal items brought aboard.

5) Itinerary Changes & Captain’s Discretion

The captain has final authority on routing, pace, and activities based on weather, tides, sea state, conservation rules, and time management. Alternative stops may be offered if conditions change.

6) Licenses & Regulations

  • Fishing: Ages 12–65 typically require a fishing license (per person). Please request this in advance.
  • Conch/Lobster (seasonal): Harvest is regulated. We follow all TCI laws and marine conservation rules.

7) Damage & Cleaning Fees

  • Guests are responsible for the cost of damage to equipment or excessive cleaning caused by negligence or prohibited behavior.

8) Governing Law

These Terms are governed by the laws of the Turks & Caicos Islands. Any disputes shall be brought before the competent courts of Turks & Caicos.
